This Privacy Policy describes how Watershed Technology, Inc. or its affiliated entities (“Watershed,” “we,” “us,” or “our”) collects, uses, shares, or otherwise processes information relating to individuals and such individuals’ legal and privacy rights. Except as described in this Privacy Policy, this Privacy Policy applies to any and all websites, mobile applications, and any other electronic or digital products or other services that are made available by Watershed and that link to this Privacy Policy, and our offline services (collectively, the “Services”).
If the individual accessing or using the Services is doing so as the authorized user of a company to which we are providing the Services under a contract, your use may be subject to the terms of that contract or other writing between us and you or the company for whom you work and on whose behalf you interact with us. The Services may permit or facilitate interactions with an interactive third-party website or service (“Social Media”), such as enabling you to “like” or “share” content. If you choose to share content or otherwise post information from or via the Services to Social Media, that data may be public, and the third party may have access to data about you and your use of the Services. You may also choose to participate on Social Media in a way that connects that third-party service with the Services (such as posting to one of our pages on a Social Media site). Doing so may allow us to collect (or the third party to share) data about you. These third-party Social Media platforms may be able to collect certain data about your visits to the Services regardless of whether or not you affirmatively interact with the feature and whether or not you are logged into (or have) an account with the third-party platform. “Usage Data” refers to data that is generated by the use of our Services or from the website infrastructure itself (for example, the duration of a page visit). Your information, including Personal Data, may be processed at Watershed’s operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those from your jurisdiction, and data may be accessible to law enforcement and national security authorities under certain circumstances.
We have several offices in countries around the world including the United States, the UK, the EU and Australia. Where we transfer personal data from the European Economic Area, the United Kingdom or Switzerland to countries that have not been found to provide an adequate level of protection, we do so using appropriate safeguards required by data protection law, such as the European Commission’s Standard Contractual Clauses (with, for transfers from Switzerland, the amendments recognised by the Swiss Federal Data Protection and Information Commissioner) and, for transfers from the UK, the International Data Transfer Agreement or the UK Addendum to the EU Standard Contractual Clauses. Our Services are not directed at children. We do not knowingly collect Personal Data from children under the age of 16, and we do not knowingly collect Personal Data from children under 13 in the United States in a manner that would require parental consent under the Children’s Online Privacy Protection Act (COPPA). If you believe we have mistakenly or unintentionally collected Personal Data of a minor without appropriate consent, please contact us using the information in Section 13 (Contact Us) below.
We will retain your Personal Data for as long as is reasonably necessary and appropriate for the purposes set out in this Privacy Policy and in accordance with applicable laws. We may also retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

Verifying Your Requests
We will take reasonable steps to verify your identity based upon the information you provide and the type of request you are making. When you exercise your “Right to Know”, “Right to Delete”, and/or “Right to Correct”, we may ask that you provide us with information, beyond your full name, and will verify that your email address is valid and active, in order to verify your identity and fulfill your request. If we are unable to verify that the individual submitting the request is the same individual about whom we have collected information (or someone authorized by that individual to act on their behalf) we will not be able to process the request.
If you are an authorized representative submitting a request on a user’s behalf, please complete the applicable request by emailing us at privacy@watershedclimate.com. We will follow up to request a signed, written permission signed by the individual who is the subject of the request authorizing you to make the request on their behalf. The written permission must state your full legal name, the full legal name of the individual who is the subject of the request and needs to be clear about the permission granted. Alternatively, you may submit a copy of a power of attorney under Probate Code sections 4000-4465. In either case, please also indicate in your email the nature of your request. The consumer’s identity, in addition to your own, will need to be independently verified for us to be able to fulfill your request. We may also ask the consumer to directly confirm with us that they provided you permission to submit a request. Please keep in mind that if we do not receive adequate proof that you are authorized to act on the consumer’s behalf, we may deny the request.
Please note that we also respond to and abide by opt-out preference signals sent through the Global Privacy Control. Any opt-out preferences you have exercised through these methods will only apply to the specific device/browser on which you made them.
