This Privacy Policy describes how Watershed Technology, Inc. or its affiliated entities (“Watershed,” “we,” “us,” or “our”) collects, uses, shares, or otherwise processes information relating to individuals (“Personal Data”) and such individuals’ legal and privacy rights. Except as described in this Privacy Policy, this Privacy Policy applies to any and all websites, mobile applications, and any other electronic or digital products or other services that are made available by Watershed and that link to this Privacy Policy, and our offline services (collectively, the “Services”).

By accessing or using the Services, you are agreeing to the practices described in this Privacy Policy. If you do not agree to the practices described in this Privacy Policy, please do not access or use the Services.

1. Processing Activities

This Privacy Policy applies to the processing of Personal Data collected by us, including when you access or use our Services. For example, we may collect Personal Data when you:

  • Visit our Services that display or link to this Privacy Policy;
  • Visit our branded social media pages;
  • Receive communications from us or otherwise communicate with us, including but not limited to emails or phone calls;
  • Register for, attend, or take part in our events, webinars, programs, or trainings;
  • Are employed by a customer of our products and services where your information has been shared with us in our capacity as controller (for example, during the contracting process); or
  • Participate in surveys, research, or other similar data collection facilitated by us.

We also provide an enterprise sustainability platform. This Privacy Policy does not apply to information collected through Watershed’s sustainability climate platform, if any. Separate terms governing such platform describe the processing of Personal Data, if any, collected with respect to such products and services.

Our Services may contain links to other websites, applications, platforms, and services maintained by third parties. The information practices of these third parties, including the social media platforms that host our branded social media pages, are governed by the privacy policies of those third parties.

2. What Data Do We Collect?

Data We Collect Directly From You

You may provide us with Personal Data such as, without limitation: first name, last name, company name, email address, phone number, country location, job title, industry, or LinkedIn profile URL.

Usage Data

“Usage Data” refers to data that is generated by the use of our Services or from the website infrastructure itself (for example, the duration of a page visit). It is collected automatically when you visit our website or other online offerings.

Device Data

Usage Data may include information such as the IP address from which you access our Services, browser type, browser version, the pages of our Services that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers, and other diagnostic data.

If you access our Services by or through a mobile device, Usage Data may also include the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, and the type of mobile Internet browser you use.

Tracking Technologies and Cookies

We use cookies and similar tracking technologies to track the activity on our Services and store certain information. Cookies are small files that are placed on your computer, mobile device, or any other device by a website, containing the details of your browsing history on that website. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze our Services. We or our third party vendors also may use certain of these technologies in emails to our customers to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded.

You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some parts of our Services. As we adopt additional technologies, we may also gather additional information through other methods, subject to our obligations under applicable laws. We do not currently respond to Do Not Track signals.

Cookies can be “persistent” or “session” cookies. Persistent cookies remain on your personal computer or mobile device when you go offline, while session cookies are deleted as soon as you close your web browser. We may use first-party cookies and third party cookies. First party cookies are cookies administered by Watershed, and third party cookies are administered by third parties.

We use both session and persistent cookies for the purposes set out below:

Advertising cookiesAdvertising cookies track activity across Services in order to understand a viewer’s interests and to provide marketing to them on the Services and other websites and services. Watershed may use cookies to show you ads for products or services that we think may interest you on devices you use and to track the performance of our ads.

Information from Third Parties

We may also receive information which may contain Personal Data from third parties, including our service providers, affiliates, and partners such as technology vendors and business information vendors, as well as from publicly available sources such as LinkedIn and third party company websites. We may also receive information about you from third party social platforms, such as Facebook or Instagram, when you interact with our social media profiles.

3. How We Use Your Personal Data

We may use Personal Data for the following purposes:

  • To provide, maintain, and improve our Services, including to monitor the usage of our Services and develop new products and services;
  • To communicate with you, including to send you emails about Watershed’s products and services;
  • To provide our Services, including for webinars or events that you request;
  • To provide you, in accordance with applicable law, with news, special offers, and general information about other goods, services, and events which we offer;
  • To manage event registrations and attendance, including for in-person events and webinars;
  • To display personalized advertisements and content;
  • To respond to your questions or requests, including to provide customer support and technical assistance;
  • To administer surveys and conduct research;
  • To detect and prevent fraud, criminal activity, or misuses of our Services, including to secure our systems, architecture, and networks;
  • To comply with legal obligations to the extent this requires processing Personal Data to protect our rights;
  • To protect our rights, privacy, safety, or property, and that of our affiliates and other parties, including to enforce agreements; and
  • To carry out any other purpose for which the information was collected.

We may combine information that we collect from you through the Services with information that we obtain from other sources. We may aggregate or de-identify Personal Data and use and disclose aggregated or de-identified data for any purpose, including for research, marketing, or disclosing such data to other parties.

4. When We Disclose Your Personal Data

We may disclose your Personal Data in the following situations:

  • With vendors: We may disclose your Personal Data with vendors that perform services on our behalf, such as those that provide data storage, payment, technology support and services, customer service, analytics, fraud prevention, legal services, and marketing services.
  • For business transfers: We may disclose or transfer your Personal Data in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • With affiliates: We may disclose your Personal Data to our affiliates. Affiliates include our parent company (as applicable) and any other subsidiaries, joint venture partners or other companies that we control or that are under common control with us. Our affiliates may use the information we disclose in a manner consistent with this Policy.
  • With your consent or at your direction: We may disclose your Personal Data to nonaffiliated third parties based on your consent or at your direction. For example, if you attend an event or webinar organized us, or download or access an asset on our website, we may disclose your Personal Data with such event sponsor or partners that offer supplementary services to Watershed, to the extent you consent to such sharing (such as through the registration form or scanning an attendee badge at an in-person event).
  • Third party networks and websites: With third party social media networks and websites, so that Watershed can market and advertise on such third party platforms and third party websites.
  • Public authorities: Under certain circumstances, we may be required to disclose your Personal Data if we believe in good faith that it is required by law or in response to valid requests by public authorities (e.g., a court or a government agency).
  • Other legal requirements: We may disclose your Personal Data in the good faith belief that such action is necessary to
    • Comply with a legal obligation;
    • Protect and defend the rights or property of Watershed, our agents and affiliates, or our employees or contractors;
    • Prevent or investigate possible wrongdoing in connection with the Services; or
    • Protect against legal liability.

5. Online Analytics and Tailored Advertising

Online Analytics

We may use third party web analytics services on the Services, such as those of Google Analytics. These vendors use the sort of technology described in “Usage Data” in Section 2 above to help us analyze how users use the Services, including by noting the third party website from which you arrive. The information collected by such technology will be disclosed to or collected directly by these vendors, who use the information to evaluate your use of the Services. We also use Google Analytics for certain purposes related to advertising, as described in the following section. To prevent Google Analytics from using your information for web analytics, you may install the Google Analytics Opt-Out Browser Add-on.

Tailored Advertising

We may also allow third party advertising networks to place cookies or other tracking technologies on your computer, mobile phone, or other device to collect information about your use of the Services in order to (a) inform, optimize, and serve marketing content based on past visits to our Services and (b) report how our marketing content impressions and interactions with these marketing impressions are related to visits to our online Services. We may also allow other unaffiliated parties (e.g., ad networks and ad servers such as Google Analytics) to serve tailored marketing to you and to access their own cookies or other tracking technologies on your computer, mobile phone, or other device you use to access the Services. Those parties that use these technologies may offer you a way to opt out of targeted advertising as described below. You may receive tailored advertising on your computer through a web browser. Cookies may be associated with de-identified data linked to or derived from data you voluntarily have submitted to us (e.g., your email address) that we may disclose to a vendor in hashed, non-human-readable form.

If you are interested in more information about tailored advertising and how you can generally control cookies from being put on your computer to deliver tailored marketing, you may visit the Network Advertising Initiative's (“NAI”) Consumer Opt-Out Link, the Digital Advertising Alliance's (“DAA”) Consumer Opt-Out Link, and/or the European Interactive Digital Advertising Alliance to opt-out of receiving tailored advertising from companies that participate in those programs. To exercise choices about how Google personalizes Display Advertising or to customize Google Display Network ads, you can visit the Google Ads Settings page. Please note that to the extent advertising technology is integrated into the Services, you may still receive advertising content even if you opt out of tailored advertising. In that case, the advertising content may not be tailored to your interests. Please also note that we do not control any of the above opt-out links and are not responsible for any choices you make using these mechanisms or the continued availability or accuracy of these mechanisms. If your browsers are configured to reject cookies when you visit these opt-out pages, or you subsequently erase your cookies, use a different computer or change web browsers, your opt-out may no longer be effective.

Your information, including Personal Data, may be processed at Watershed’s operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those from your jurisdiction, and data may be accessible to law enforcement and national security authorities under certain circumstances.

By using the Services, or providing us with any information, you consent to the collection, processing, maintenance, and transfer of such information in and to the United States and other applicable countries in which the privacy laws may not be as comprehensive as, or equivalent to, those in the country where you reside or are a citizen.

7. Children

Our Services are not directed at children. We do not knowingly collect Personal Data from children under the age of 18. If you believe we have mistakenly or unintentionally collected Personal Data of a minor without appropriate consent, please contact us using the information in Section 13 below.

8. How Long We Keep Your Personal Data

We will retain your Personal Data for as long as is necessary for the purposes set out in this Privacy Policy. We may also retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

9. Your Choices

We offer you certain choices regarding the collection, use, and disclosure of your Personal Data.

Marketing Communications

You can unsubscribe from marketing emails by following the directions in those emails. Please note that if you unsubscribe from marketing emails, we may still send you administrative emails regarding the Services.

Cookies and Analytics

You can opt out of certain cookie-related and analytics processing by following the instructions in this Privacy Policy.

Your Rights

You may have certain rights relating to your Personal Data, subject to local data protection laws. Depending on the applicable laws these rights may include the right to:

  • Access your Personal Data;
  • Be notified of which categories of Personal Data we collect for third party advertising purposes;
  • Know more about how we process your Personal Data, including requesting information about the categories of Personal Data we collect or disclose about you, the categories of sources of such information, the business or commercial purpose for collecting such information, and the categories of unaffiliated parties to whom we disclose such Personal Data;
  • Correct Personal Data that we hold about you;
  • Object to or restrict the processing of your Personal Data, including to prevent the processing of your Personal Data for direct marketing purposes;
  • Object to the sale of your Personal Data;
  • Delete or remove your Personal Data;
  • Transfer your Personal Data to another controller, if possible;
  • Withdraw your consent, if we based our processing on consent;
  • Know more information about the financial incentives we offer you, if any;
  • Not be discriminated against for exercising your rights.

Exercising Your Rights

You may exercise your rights by contacting us as noted in Section 13 below. Please note that we may ask you to verify your identity before responding to such requests. If we are unable to verify your identity, we may be unable to respond to your requests. We will try our best to respond to you as soon as practicable.

If you are located in the European Economic Area or United Kingdom, you have the right to complain to a data protection authority about our collection and use of your Personal Data.

Please note that certain information may be exempt from such requests under applicable law. For example, we may retain certain information for legal compliance and to secure our Services. We may need certain information in order to provide the Services to you; if you ask us to delete it, you may no longer be able to use the Services.

10. Security of your Personal Data

The security of your Personal Data is important to us, but no method of transmission over the Internet, or method of electronic storage, is fully secure. While we strive to use commercially acceptable means to protect your Personal Data through administrative, physical, organizational, and technical measures, we cannot guarantee its absolute security.

Our Services may contain links to other websites that are not operated by us. If you click on a third party link, you will be directed to that third party’s site. We advise you to review the privacy policy of every site you visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

12. Changes to this Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the “Last updated” date at the top of this Privacy Policy.

Please review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page, except as otherwise provided herein. By continuing to use the Services, you are confirming that you have read and understood the latest version of this Privacy Policy.

14. Additional Information for Residents of the European Economic Area and United Kingdom

Watershed is considered the “data controller” of the Personal Data (as defined under the General Data Protection Regulation) we handle under this Privacy Policy. In other words, Watershed is responsible for deciding how to collect, use, and disclose Personal Data, subject to applicable law. The laws of the European Economic Area and the United Kingdom require data controllers to tell you about the legal ground that they rely on for using, sharing, or disclosing your personal data. We process your Personal Data under the following legal bases:

  • Contractual Commitments: We may use, share, or disclose Personal Data to honor our contractual commitments to you. For example, we will process your Personal Data to comply with our agreements with you, and to honor our commitments in any contracts that we have with you;
  • Consent: You have given your consent for processing Personal Data for one or more specific purposes;
  • Legal obligations: Processing Personal Data is necessary for compliance with a legal obligation to which we are subject; or
  • Legitimate interests: Processing Personal Data is necessary for the purposes of the legitimate interests pursued by Watershed, such as customer service, certain promotional activities, analyzing and improving our business, providing security for the Services, preventing fraud, and managing legal issues.

In addition to those rights described in Section 9, you have the right to lodge a complaint with the relevant supervisory authority. However, we encourage you to contact us first, and we will do our best to resolve your concern.

15. Additional Information for California Residents

The California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (“CCPA”) requires us to provide additional information to California residents. This Section 15 only applies to you if you are a California resident using our Services as described in Section 1 above. It does not apply to information collected about employees, former employees, job candidates, or independent contractors. We may share Personal Data (in the form of identifiers and internet activity information) with third party advertisers for purposes of targeting advertisements on non-Watershed websites, applications, and services.

Under the CCPA, we also have to provide you with the categories of “personal information” and “sensitive personal information” we collect and disclose for “business or commercial purposes.” Where we refer to “personal information” or “sensitive personal information” in quotes, we are referring to those terms as uniquely defined in the CCPA.

In the twelve months leading up to the effective date of this Privacy Policy, we have collected and disclosed the categories of “personal information” described in Section 2 for business or commercial purposes. The categories of “personal information” are: identifiers, commercial or transactional information, internet or other electronic network activity information, general geolocation data, professional or employment-related information, audio or video information (such as through video calls), other information about you that you may provide to us voluntarily, other information that may identify you, and inferences drawn from the information we collect.

We process the categories of “personal information” identified above for the purposes as described in more detail in Section 3 above.

We collect the categories of “personal information” identified above from the following sources: (1) directly from you; (2) through your use of the Services; and (3) other parties such as data brokers and other unaffiliated parties.

We disclose the categories of “personal information” identified above for our business purposes for the purposes described in Section 3 above and to the entities described in Section 4 above.

The CCPA sets forth certain obligations for businesses that “sell” or “share” “personal information”. Where we refer to “sell” or “share” (or their variants) in quotes, we are referring to those terms as uniquely defined in the CCPA. We may use third party analytics services and online advertising services that may result in the “sharing” of online identifiers (e.g., cookie data, IP addresses, device identifiers, general geolocation information, and usage information) with advertising partners to advertise the Services on third party websites. If you or your authorized agent would like to opt out of our “sharing” of your information for such purposes, you may do so by using the tools described in Section 5 above on Tailored Advertising. We do not knowingly “sell” or “share” the “personal information” of children under 16.

California law grants state residents certain rights, including the rights to know and access specific types of “personal information”, to learn how we process “personal information”, to request deletion of “personal information”, to request correction of “personal information”, and not to be denied goods or services for exercising these rights.

For information on how to exercise your rights, please refer to Section 9 of this Privacy Policy. The CCPA also allows you to limit the use or disclosure of your “sensitive personal information” if your “sensitive personal information” is used for certain purposes. Please note that we do not use or disclose “sensitive personal information” other than for purposes for which you cannot opt out under the CCPA.

Please note that we also respond to and abide by opt-out preference signals sent through the Global Privacy Control. Any opt out preferences you have exercised through these methods will only apply to the specific device/browser on which you made them.
